Iowa recognizes the right of gay and lesbian couples to marry. And because the US Supreme Court overturned parts of the Defense of Marriage Act (DOMA), the federal government also recognizes LGBT marriages. This means same-sex married couples living in Iowa are eligible for all rights and benefits afforded to heterosexual married couples.
Here is a run-down on Iowa law affecting the LGBTQ community:
1 Recognition of Same-Sex Relationships: Iowa has provided benefits to same-sex partners of state employees since 2003.
Iowa has allowed for state recognition of same-sex marriages performed in and out of the state since April 3, 2009, after the Iowa Supreme Court unanimously upheld a ruling by the Polk County District Court in Varnum v. Brien which effectively forced the state to rescind any outstanding discrimination against same-sex couples who wish to have their marriages recognized and licensed under state law.Iowa marriage licenses were issued to same-sex couples for the first time on April 27, 2009.
In response to the decision, several attempts to amend the state constitution, either by presenting a ballot initiative before the voters or calling a state constitutional convention, to ban same-sex marriage have failed.
To date, sixteen states – CA, CT, DE, HI, IA, IL, ME, MD, MA, MN, NH, NJ, NY, RI, VT, and WA – plus Washington, D.C. have the freedom to marry for same-sex couples.
2 Adoption Law: Joint adoptions by same-sex parents have been legal since a ruling by the Iowa Supreme Court in 2008.Iowa law allows individuals and married couples, regardless of sexual orientation, to adopt.
3 Anti-Discrimination Law: Since 2007, Iowa has outlawed discrimination on the basis of sexual orientation and gender identity. Iowa’s hate crime law covers hate crimes based on sexual orientation but not gender identity.
4 Sodomy Law: The state’s law criminalizing same-sex sexual activity was repealed in 1978.
5Public Opinion: A July 2013 Public Policy Polling poll found that 47% of Iowa voters thought that same-sex marriage should be legal, while 44% thought it should be illegal and 9% were not sure.
